California Paid Sick Leave Poster Mandatory
The Paid Sick Leave Poster is a California sick leave law poster provided for businesses by the California Department Of Industrial Relations. This is a required poster for all California employers, and any business that fails to post this notification may be subject to penalties or fines.
This mandatory poster is a summary of the entitlements and usages of paid sick law for employees. It lists the dates and details for each entitlement a employee may be eligible for. Additional information is listed on the website at the bottom of the poster.
Division of Labor Standards Enf orcement Labor Commissioner's Office THIS P OSTER M UST BE DISPLAYED W HERE EMPLOYEES C AN EASILY READ IT (Poster may be printed on 8 ½” x 11” letter size paper) HEALTHY WORKPLACES/HEALTHY FAMILIES ACT: CALIFORNIA P AID SICK LEAVE (as amended effective 1/1/2024) Entitlement: • An employee who, on or after July 1, 2015, works in California for 30 or more days within a year from the beginning of employment is entitled to paid sic k leave. • Paid sick leave accrues at the rate of one hour per ev ery 30 hours worked, paid at the employee’s regular wage rate. Accrual shall begin on the first day of em ployment or July 1, 2015, whichever is later . A ccrued paid s ick leave s hall carry ov er to the following y ear of employment and m ay be c apped at 80 hours or 10 day s. • An employer can also provide 5 days or 40 hour s, whichever is greater, of paid sick leav e "up-front" at the beginning of a 12-m onth per iod. No accrual or carry over is r equired. • Other accrual plans that meet specified conditions, including PTO plans, may also satisfy the requirements. Usage : • An employee may use paid sick days beginning on the 90 th day of employment. • An employer shall provide paid sick days upon the oral or written request of an em ployee for themselves or a family member for the diagnosis, care or treatment of an existing health condition or preventive care, or spec ified purposes for an employee who is a victim of dom estic violence, sexual as sault, or stalking. • An employer may limit the use of paid sick days to 40 hours or five days , whichever is greater, in each y ear of employment. Retal iation or discrimination against an employee who requests paid sick days or uses paid sick days or both is prohibited. A n employee can file a complaint with the Labor Commissioner against an employer who retaliates or discriminates against the employee.
